The Indian constitution envisions a society in which social, economic, and legal justice are Low-Income available to all based on equality.
To implement the constitutional duty of equality before the law, the state must provide access to justice, Low-Income which means that no citizen’s chances of obtaining justice are denied because of economic or another handicap. According to the new concept, when an indigent litigant is forced to contest a claim on a rich character, he should not just be granted financial, legal aid. Still, he should also be provided with advice and assistance in resolving disputes through negotiation, consultation, compromise, arbitration, or any other means.
This is only feasible if we shift our perspective and reorient our thinking process. Only then will the subject of social justice be able to transform the fate of impoverished litigants. The Indian Constitution ensures fairness before the law also similar protection under the law, regardless of caste, color, religion, income, or status.
Various legal rules about free legal assistance are provided in India to assist impoverished litigants. The Preamble to the Indian Constitution strives to provide social, economic, and political fairness to all Indian citizens. If the primary freedoms secured by Articles 14, 19, and 21 in favor of Indian citizens are infringed, the constitutional remedies are useless unless and until the impoverished plaintiff receives adequate assistance.
The Advocate Act of 1966 has measures that serve to encourage free legal aid for indigent plaintiffs.
2. Poor accused individuals are entitled to free defense counsel in prosecutions under Section 302 of the I.P.C.
3. an indigent litigant is entitled to free legal assistance while filing a Motor Vehicle Act accident claim petition.
4. There is no Court cost for filing a Consumer Protection Act complaint.
5. Order 33 of the Civil Procedure Code permits impoverished people to file cases without paying any Court fees.
6. Similar rights exist for indigent/poor litigants’ appeals.
