Governments defaming judges is a new and terrible trend: SC

The remarks came as a three-judge bench heard appeals against a Chhattisgarh High Court order that quashed an FIR installed under the Prevention of Corruption Act against former Chief Minister Raman Singh’s principal secretary and his wife after the BJP government was voted out and the Congress party took power.

On Friday, Chief Justice of India N V Ramana stated that the government is “maligning” judges in a “new trend.”

The CJI, who presided over a bench that included Justices Krishna Murari and Hima Kohli, stated, “It’s a new trend… The government has begun to disparage the judiciary. It’s too bad… We’re also keeping an eye on things in court. It’s a new trend these days. Previously, we saw this method applied by private parties. Every day, we keep an eye on everything.”

He made the remarks while the bench was hearing appeals against a Chhattisgarh High Court order that quashed an FIR filed under the Prevention of Corruption Act against former Chief Minister Raman Singh’s Principal Secretary Aman Singh and his wife Yasmin Singh in 2020 after the BJP government was defeated and the Congress took power in the state.

The Economic Offences Wing of the Chhattisgarh Police filed the FIR against them on February 25, 2020, based on a complaint to the Chief Minister by one Uchit Sharma, a “social and anti-corruption activist,” requesting an investigation into the couple’s disproportionate assets.
In an interim decision issued on February 28, 2020, the High Court instructed that no coercive measures be implemented against the couple. The High Court quashed the FIR in an order dated January 10, 2022, stating that “all the allegations leveled against the petitioner are prima facie based on probabilities, and on the basis of probability, no person can be prosecuted.”
In its ruling, the High Court further stated that Sharma’s allegation “was signed by the CM himself, and this was mentioned ‘CS/EOW se jaanch karayein.” On November 11, 2019, a preliminary investigation was launched against Singh.
Sharma and the state administration appealed the High Court verdict to the Supreme Court. The CJI made these remarks while reviewing the appeals.
